In the event of a divorce, if there are children, it is your responsibility to ensure that the care and upbringing of the children are properly arranged. A parenting plan must be drawn up.
There are minimum requirements for a parenting plan. At a minimum, the parenting plan must specify how care and upbringing will be arranged, how information about important matters will be communicated, and how the costs of care and upbringing will be handled.
The parenting plan must also describe how you have involved the child (or children) in the process of creating the parenting plan.
In short, the parenting plan sets out how custody, upbringing, visitation, finances, and communication will be arranged between the former partners.
Parents who are married, in a registered partnership, or cohabiting parents with joint custody are required to draw up a parenting plan upon separation.
If you are unable to reach an agreement, the court will have to establish arrangements regarding the children.
Avoid creating a parenting plan that does not meet your needs or in which your obligations feel suffocating, and engage us as experts to work with you to draft a parenting plan that is forward-looking and provides clarity and peace of mind. This is in your child’s best interest.
